Dear Merv

Extension
Allestree, Hall Lane, South Wootton, King's Lynn, Norfolk PE30 3LQ

The distance from the flue to the neighbours would appear to be within recommended guidelines. As the prevailing wind in this district is south westerly, the likelihood of the smoke/odour from the flue adversely affecting the residential amenity of the surrounding properties is reduced. Clearly wind direction and other weather such as fog or damp conditions can affect the dispersal of smoke upwards, allowing it to 'hang low'. Helpfully, the neighbouring dwellings and those immediately behind are single storey so there are no first floor windows in line of any plume. Whilst not having grounds to object to this proposal, I do request the following condition and informative, to protect the neighbours and occupiers of the houses opposite, please:

Burner/fireplace and flue/chimney
The flue/chimney and burner/fireplace shall be installed and fitted as per the manufacturer's instructions and advice, and thereafter properly maintained and cleaned to ensure they function correctly. Only fuel recommended by the manufacturer shall be burnt, to prevent disamenity to others due to smoke and odour.

Environmental Protection Act 1990
Under the Environmental Protection Act 1990, the Local Authority has a duty to investigate complaints of nuisance and should a complaint be received, irrespective of planning consent, the Local Authority may on determination of a Statutory Nuisance serve a legal notice requiring any said nuisance to be abated and failure to comply may result in prosecution. Further advice may be sought from the Community Safety and Neighbourhood Nuisance Team on this matter where necessary.

Kind regards

Suzi Pimlott (Mrs)
